Terms of Service & End-User License Agreement

Welcome to CarServ! These Terms of Service and End-User License Agreement ("Terms" or "EULA") govern your use of the CarServ platform, website, and mobile application ("Licensed Application"). By creating an account, downloading, installing, or using our services, you agree to these Terms.

Notice: CarServ is currently operated as a sole proprietorship by Pratik Khatwani doing business as "CarServ" (referred to as "Developer," "we," "us," "our," or "CarServ"). CarServ is not a corporation, LLC, or other legal entity at this time. By using this service, you acknowledge this structure and agree to be bound by these Terms.

1. Acknowledgement

You and the Developer acknowledge that this EULA is concluded between You and the Developer only, and not with Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for the Licensed Application and the content thereof. This EULA does not provide for usage rules for the Licensed Application that conflict with the Apple Media Services Terms and Conditions as of the effective date.

2. Scope of License

The Developer grants you a limited, non-transferable license to use the Licensed Application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. The Licensed Application may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.

5. Subscription Plans and Payment

5.1 Free Plan

The free plan includes limited features as described on our pricing page. Free accounts may be subject to usage limits.

5.2 Paid Plans

CarServ offers auto-renewable subscriptions through the Apple App Store and web platform:

By subscribing, you authorize CarServ to charge your payment method on a recurring basis at the start of each billing period until you cancel. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel subscriptions through your device's Settings > Apple ID > Subscriptions (for App Store purchases), or through the web app's account settings (for web purchases).

Payments are processed through two platforms depending on how you subscribe:

5.4 Cancellation and Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial periods.

We may change subscription prices with 30 days' notice. Price changes apply to the next billing period after notice.

6. Maintenance and Support

The Developer is solely responsible for providing any maintenance and support services with respect to the Licensed Application. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application. For support, contact us at carserv.help@gmail.com.

7. Warranty

The Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the Developer's sole responsibility.

THE LICENSED APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not warrant that the service will be uninterrupted or error-free, that AI analysis will be accurate or complete, or that the service will meet your specific requirements. CarServ is an informational service and is not a substitute for professional mechanical advice.

8. Product Claims

You and the Developer acknowledge that the Developer, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of the Licensed Application, including but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

9. User Content

9.1 Your Content

You retain ownership of content you upload (documents, images, vehicle information). By uploading content, you grant us a license to store, process, and display it to provide our services. This license terminates when you delete your account.

Documents you upload are processed by AI (Anthropic Claude) to extract information such as service dates, costs, and work performed. Documents are sent to the AI in memory for processing and are not stored as images on our servers. Only the extracted text data is saved to your account. The AI analysis is provided "as is" and should be verified for accuracy. We are not responsible for errors in AI-generated analysis.

10. Account Deletion

You may delete your account at any time through the app's Settings screen. Account deletion is permanent and will remove all your data, including vehicles, service records, and any fleet data you own. This action cannot be undone.

11. Intellectual Property

CarServ and its original content, features, and functionality are the exclusive property of CarServ and its owner, and are protected by copyright, trademark, and other intellectual property laws.

You and the Developer acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

IMPORTANT: TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARSERV AND ITS OWNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Our total aggregate liability for any claims shall not exceed the lesser of: (a) the amount you paid us in the 12 months preceding the claim, or (b) fifty dollars ($50).

14. Legal Compliance

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

15. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the Licensed Application. This includes, but is not limited to, your wireless data service agreement when using the app over a cellular network, and the terms of any third-party services accessed through the app (such as Stripe for payments and Anthropic for AI features).

16. Third-Party Beneficiary

You and the Developer acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

17. Indemnification

You agree to indemnify and hold harmless CarServ from and against all claims, damages, losses, costs, and expenses arising from your use of the service, your violation of these Terms, or your violation of any third-party rights or applicable law.

18. Termination

We may terminate or suspend your account at any time for violation of these Terms. You may delete your account at any time through the app. Upon termination or deletion, your data will be permanently removed.

19. Dispute Resolution

19.1 Informal Resolution

Before filing any formal dispute, you agree to first contact us at carserv.help@gmail.com and attempt to resolve the dispute informally for at least 30 days.

19.2 Binding Arbitration

If informal resolution fails, any dispute shall be resolved through binding arbitration under the rules of the American Arbitration Association. The arbitration shall be conducted in California, USA, or via telephone/video at the discretion of the arbitrator.

19.3 Class Action Waiver

YOU AGREE TO WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. All disputes must be brought in your individual capacity.

19.4 Limitation Period

Any claim must be brought within one (1) year of the event giving rise to the claim, or the claim is permanently barred.

20. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

21. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the service. Continued use after changes constitutes acceptance.

22. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CarServ regarding your use of the service.
